We are Malta Developers Association, a non-governmental organisation and voice of private Real Estate developers in Malta.

When you shop with us or access our website services, these terms apply. They are important for both of us as they set out what we expect from each other and they also give you helpful information. Registering

To be able to buy from us, you will need to register an account with us. To do this you must be over 16 and will need an email address, a username and password. Setting up an account will also give you additional benefits such as regular newsletters. Once registered, you can update your details using the My Account section. If you need to update your account details simply click on ‘My Account’.

Account Password

For your account security, you will be asked to set up a password to your account. If you are unable to remember your password simply select “Forgotten Password” on the Login page, you will then need to input your email address and follow the steps in the email to reset your password. If you are still having problems you will need to contact customer care who will reset it for you. After that you will be able to re-assign a new password at your leisure using the Account section.

Buying Online

To find a product or service you wish to buy you can either search by product name or keywords using the search facility located in the top right-hand corner of the page. Alternatively, if you see an area of interest, you can make use of the main menu or use the categories displayed on the right-hand side of the site. This will guide you to a product listing and when you click on a product this will take you to the product page. From the product page, you can add the product to your basket. All our prices are quoted in Euro and include VAT.

Payment Process

The payment pages used at MDA.COM.MT are secure and you can safely enter your card details to pay for your order. We accept the following methods of payment: Mastercard, VISA, VISA Debit, VISA Electron, Maestro, American Express (AMEX) and PayPal. You must be authorised to use the account because it is in your name or you have permission from the account holder to use it. On the payment screen, select the desired payment option and proceed to the next section where you will enter the card details. Based on the type of card you are using for payment, you may then be asked to enter further details to enhance the security of the transaction. All credit and debit card holders are subject to validation and authorisation by both us and the card issuer, to maintain security and prevent fraud. Internet fraud is Illegal and perpetrators will be prosecuted in all cases.

Authorisation Check

When you place an order, you should receive an acknowledgement e-mail confirming receipt of your order. We then carry out a standard pre-authorisation check to make sure there’s enough money on the card. We only accept your order once payment has been approved and we have debited the payment card (and then the contract is made based on these terms).

Confirmation

Once you have placed your order you will be presented with an order confirmation screen detailing what you have bought, how much it cost and delivery options. At this time, you will also be sent a confirmation by email re-stating the details for your records. We will also inform you of your tracking reference number. By clicking on the tracking reference link, you will be taken to the courier’s website where you can see the progress of your delivery.

Changes after order

There’s a lot going on here at MDA.COM.MT and from time to time our staff may price up or describe a product or promo wrongly. If we discover an error for any goods you’ve ordered, we will tell you ASAP and give you the option of reconfirming your order (at the correct price) or cancelling it. If we can’t get in touch with you, we will treat the order as cancelled. If you cancel and you’ve already paid, we will refund you in full.

Cancelling an Order

You may be able to cancel (not change) your order within a short period of ordering – timings depend on your chosen delivery method (and will be set out in the acknowledgement email). You cannot change your order – you’ll need to cancel (and/or return original item(s)), and re-order.

All orders are subject to availability and confirmation of the order price. Don’t worry, if there’s an issue with an order, we’ll get in touch with you.

Warranty

We warrant that the goods which we supply are of satisfactory quality and are fit for the purpose for which they are commonly supplied.

Indemnity

You agree to indemnify, defend and hold harmless MDA.COM.MT, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use (or misuse) of this website or your breach of the Terms and Conditions.

Pre-order

We offer some items on our website that are on Pre-order. Pre-order allows you to order an item either prior to the official launch or before the stock becomes available for sale. The item, along with the rest of the order will be processed once the stock becomes available, the date shown on the website is only a guide. We will however endeavour to process your order ready for delivery to you either on the date shown or shortly afterwards.

Refunds

If a full refund including the original delivery costs is required, we need to be informed fourteen (14) days after the receipt of the order. The order must be then returned to us within fourteen (14) days after we have been informed of the cancellation, however you will be responsible for the cost of returns the goods to us. If a refund is payable to you we will process it as soon as possible and in any case within fourteen (14) days of receipt of the original order back to us.The returned goods need to be in their original packaging and they need to be in a sellable condition. Return postage is at your own cost and risk.You have a legal obligation to take reasonable care of the goods while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation. This applies to all goods that are returned.Our returns policy does not affect your statutory rights.

Defective Goods

If you return goods claiming they are defective, we will examine the returned goods and will notify you of your refund via e-mail within a reasonable period of time. We will process the refund due to you as soon as possible and, in any case within thirty (30) days of the day we confirm via e-mail that you are entitled to a refund for defective goods.If a refund or reimbursement is payable to you, we will transfer the money using the same method originally used by you to pay for your purchase.  Once a refund has been issued you will receive a confirmation email detailing the amount which has been refunded and the item which we have received back. We aim to process all returns as quickly as possible and you should receive confirmation of this within a week of having returned the item. Please note that at busy times of the year such as public holidays, these times may increase.

Security

We view the security of our customer’s data as paramount. Any personal data you provide to us and from which you can be identified is stored securely and confidentially and is processed in accordance with applicable legislation and this privacy policy, which sets out what personal data we collect about you when you interact with us and how we use your data.

We take appropriate technical and organisational measures to protect against unauthorised or unlawful processing of your personal data, including encrypting your information to applicable industry standards. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. So, you only need to look in one place to find out all you need to know about how MDA.COM.MT collects and processes your personal information, this policy covers our Website and any correspondence you have with MDA.COM.MT in relation to our retail offering.

Tampering

We know it’s obvious, but you must not misuse, tamper hack, introduce viruses, trojans, worms, logic bombs or other technologically harmful material or carry out denial of service attacks etc. with our website or other services or otherwise mess with our tech or functionality or steal any of our data. Doing any of these things may be a criminal offence, but they also get in the way of us giving our loyal MDA.COM.MT customers the best service, so we take them really seriously. MDA.COM.MT will report any such breach or activity (and all information about the people carrying it out) to the relevant law enforcement authorities. You are also not allowed to use automated systems or software to extract data from our Website (AKA ‘screen scraping’).

Changes

We have the right to amend, remove or vary our services and/or any part of the website (including our Terms and Conditions) at any time.

Laws

These terms and our dealings with you are subject to Maltese law and the exclusive jurisdiction of the Maltese courts.

Intellectual Property and Trademarks

MDA.COM.MT owns or has permission to use the intellectual property rights in its website and its content. These rights are protected around the world. All such rights are reserved. You are allowed to store, print and display our website content only for your own personal use. You are not allowed to use any part of the website for commercial purposes unless you have our permission. You’re also not allowed to use the MDA.COM.MT logo or any MDA.COM.MT brand or trade mark (or any marks which are colourably similar) without our permission.

Data Protection

Our Privacy Policy sets out how we’ll use your information. If your details change, remember that you need to update ‘My Account’ so we can continue giving you our best service. Information about cookies is found on out Privacy Policy.

Virus protection

We recommend you use virus protection software when using any website, including ours. Although we have a dedicated team who work hard to stop people messing with our website, we cannot guarantee that it will always be secure from bugs, viruses or trouble-makers.

Social Media Interaction

At MDA.COM.MT, we love being able to interact with and chat to you through social media. However, we can’t control those social media platforms or how you set your profiles on them. Please check and set your privacy settings so that you understand and are comfortable with how your personal information on those platforms will be used.
