The Malta Developers Association refers to recent protests against the approval of building schemes in sites known as ‘rationalisation areas’. These areas were included in developable areas by means of a decision approved by Parliament in 2006.
While the MDA recognises that the addition of some of these sites to developable areas was a controversial decision, the fact is that a decision taken by Parliament cannot in any manner be rendered null by the Planning Authority’s technical committee.On the contrary, the Planning Authority is obliged to seek solutions after leaving people in limbo for so many years.
Since these areas were approved, there were a substantial number of purchases of sites within them, all made in good faith since the areas had been approved as developable by the highest institution of the country.
MDA therefore cannot accept the attitude of the few that are ignoring these facts and expect the state to meddle with citizens’ rights by first declaring land as developable and, many years later, abruptly change the status of the same land. This after a lot of money and time was invested in the proposals submitted to the Planning Authority by means of a Planning Control (PC) application.
If there are any particular sites that the State today recognises as ones that should not have been included in the rationalisation areas, the State is obliged to pay damages to the owners who bought the land on the basis of a decision taken by the same State that is now being asked to have second thoughts.

L-MDA ser tinsisti li permessi approvati għandhom ikunu onorati
Il-Malta Developers Association (MDA) tirreferi għal protesti li saru riċentement kontra l-approvazzjoni ta’ skemi f’arji magħrufa bħala ‘rationalistaion areas’. Dawn l-arji kienu inklużi fl-arji għall-iżvilupp permezz ta’ deċiżjoni tal-Parlament fl-2006.
Filwaqt li l-MDA tifhem li ż-żieda ta’ wħud minn dawn is-siti fl-arji tal-iżvilupp kienet deċiżjoni kontroversjali, jibqa’ l-fatt li deċiżjoni tal-Parlament ma tistax tkun imħassra bl-ebda mod b’vot tal-kumitat tekniku tal-Awtorità tal-Ippjanar. Għall-kuntrarju, l-Awtorità tal-Ippjanar hi obbligata tfittex soluzzjonijiet wara li numru ta’ nies tħallew fil-limbu għal ħafna snin.
Minn meta dawn l-arji kienu approvati saru numru ta’ kuntratti ta’ xiri bona fide ta’ siti inklużi fihom a bażi tal-fatt li dawn s-siti kienu inklużi fl-arji tal-iżvilupp mill-ogħla istituzzjoni tal-pajjiż.
Għaldaqstant l-MDA ma tistax taċċetta l-attitudni tal-ftit li qed jinjoraw il-fatti u jippretendu li l-istat jilgħab bid-drittijiet taċ-ċittadin billi l-ewwel jiddikjara li l-art hi tajba għall-iżvilupp u ħafna snin wara jibdel ħesrem l-istatus ta’ din l-art. Dan wara li ħafna flus u żmien kienu investiti fi proposti sottomessi lill-Awtorità tal-Ippjanar permezz ta’ applikazzjoni PC (Planning Control).
Jekk hemm xi arji partikolari li llum l-Istat qed jirrikonoxxi li ma kellhomx jiddaħħlu fir-‘rationalistaion areas’, allura l-Istat hu obbligat iħallas id-danni lis-sidien li xtraw l-art fuq deċiżjoni tal-istess Stat li issa qed jintalab ibiddel fehmtu.
