l-MDA tagħmel riferenza għal-promulgazzjoni tar-regolamenti l-ġodda tas-saħħa u s-sigurta fuq is-siti tal-kostruzzjoni, liema liġi ser tkun effettiva minn żmien sitt xhur mid-data tal-ippublikazzjoni tagħħha. Dawn ir-regolamenti ġodda huma riżultat ta’ xogħol siewi li kellu jieħu l-perkors tiegħu iżda li żgur li ser iġib titjib fid-direzzjoni t-tajba sabiex jiġi żgurat illi s-saħħa u s-sigurta tkompli tingħata l-importanza tant mistħoqqa fuq is-siti tal-kostruzzjoni.

l-MDA kienet fil-quċċata sabiex tinsisti fuq il-bidliet neċessarji fil-liġi, kemm fid-dawl ta’ osservazzjonijiet tal-membri tagħha kif ukoll fid-dawl tad-direttivi tal-Unjoni Ewropeja. Din il-liġi l-ġdida ser tkun qed tagħti lok illi żviluppaturi jappuntaw rappreżentant tagħhom, li jkunu professjonisti, sabiex jieħdu ħsieb ir-responsabbilitajiet relatati mas-saħħa u s-sigurta għan-nom tagħhom. Dan l-irwol ġdid ser ikun qiegħed jiżgura illi d-direzzjonijiet tas-supervisors tal-proġett ikunu qiegħdin jiġu implimentati. Fost il- bidliet ser ikun hemm iż-żieda ta’ poteri lis-supervisor tal-proġett illi ser ikun jista wkoll iwaqqaf ix-xogħolijiet f’każ illi jiġu indentifikati xi riskji fis-sit u anke l-obligu li jżomm informata lill-awtorita’ kompetenti. Addizzjonalment, l-istess awtorita’ ser tibda żżomm reġistru li fih ser ikun hemm informazzjoni dwar il-professjonisti kwalifikati li jkunu jistgħu jassumu l-irwoli relatati mas-saħħa u sigurta. L-MDA ser tkun qed torganizza sessjonijiet ta’ informazzjoni fuq l-implikazzjonijiet fil-prattika ta’ din il-liġi għal-Membri interessati tagħha.

L-MDA hija kunfidenti illi l-introduzzjoni ta’ din il-liġi ser tkun qiegħda ttejjeb is-saħħa u s-sigurta fuq il-post tax-xogħol u ttenni li x-xogħol tal-assoċjazzjoni ser ikompli mingħajr waqfien u dan billi tkompli timbotta, taħdem u tikkonsulta mal-entitajiet ul- politiċi kollha għal aktar riformi li ser jgħollu l-kwalita u l-livell tas-settur. L-MDA, filwaqt illi qiegħda tilqa din ir-riforma, tibqa tinsisti li sforzi kbar jeħtieġu li jsiru sabiex tonqos il-burokrazija eċċessiva li ma twassal għal ebda rizultat bil-konsegwenza li qiegħda toħnoq l-industrija u żżid spejjeż inutili li attwalment iwaslu għall-effett li familji Maltin ihallsu eluf kbar żejda biex jixtru d-djar tagħhom.

The MDA makes reference to the promulgation of the new regulations pertaining to the health and safety on the construction sites which will be effective as of six months from the date of its publication. These new regulations are the result of hard work which had to take its time however brings with certainty improvements in the right direction, ensureing that the health and safety is given its due importance on the construction site.

The MDA was on the forefront on insisting on the necessary changes in the law, in light of the observations made by its members as well as the directives of the European Union. This new legislation provides the opportunity to developers to appoint professional representatives to take on the responsibilities related to the health and safety on their behalf. This new role will ensure that the direction given by the  project supervisors will be implemented effectively. Amongst the changes, more power will be given to these same supervisors who will have the authority to order the works to stop in cases where risks are identified. They will also have the duty to keep the competent authority up to date. Additionally, the same authority will be keeping a register with all the information on the qualified professionals who can assume roles related to health and safety. The MDA will also be organising information seminars on the practical implications of the law to its interested members.

The MDA is confident that the introduction of this legislation will be improving the health and safety on the workplace. The MDA’s efforts will continue. It will push, work, and consult with all the entities and politicians for more reforms which improve the quality and the level of the sector. The MDA, whilst welcoming this reform, continues to insist that  huge efforts are required to reduce the excessive bureaucracy which brings no result but has the consequence of suffocating the industry and add unnecessary expenses with the effect that the Maltese families having to pay thousands of extra euros to purchase their homes.
