MDA welcomes regularisation Legal Notice

The Malta Developers Association refers to the amnesty that the Planning Authority is granting to sanction minor irregularities in existing buildings (Legal Notice 285 of 2016).

The MDA agrees in principle with this amnesty because there are a substantial number of property owners, including families, who have severalirregularities which could never be sanctioned. These remained on paper for a number of years to the detriment of owners who want to sell their property. An amnesty like this announced is the only remedy for this type of problem.

Despite all this, the MDA emphasises that the Authority should take into consideration the impact on the existing surroundings to avoid new anomalies.

The MDA appeals to all its members that where they sold properties with these irregularities that are time barred should also be responsible and come forward to refund them voluntarily the fees that these current owners have to pay to become ‘in regola’.

Finally, the MDA also appeals to the authorities from today onwards to increase the penalties being imposed on whoever abuses and breaks the law.

L-MDA tilqa’ l-Avviż Legali fuq irregolaritajiet

Il-Malta Developers Association (MDA) tirreferi għall-amnestija li se tingħata mill-Awtorità tal-Ippjanar (PA) biex irregolaritajiet żgħar f’bini eżistenti ikunu jistgħu jiġu sanzjonata (l-Avviż Legali 285 tal-2016).

L-MDA taqbel fil-prinċipju ma’ din l-amnestija għaliex hawn numru sostanzjali ta’ sidien ta’ proprjetà, fosthom familji, li għandhom numru ta’ irregolaritajiet u li ma setgħu qatt jiġu sanzjonata. Dawn baqgħu hekk fuq il-karta għal numru ta’ snin b’dannu għas-sidien li jkunu jridu jbiegħu il-proprjetà tagħhom. Amnestija bħal dik imħabbra hi l-unika rimedju għal din it-tip ta’ problema.

L-MDA madankollu jenfasizza li l-Awtorità għandha tieħu in konsiderazzjoni l-impatt li jistgħu jħallu fuq il-madwar sabiex nevitaw anomaliji ġodda.

L-MDA tappella lill-membri tagħha kollha li fejn biegħu proprjetajiet b’dawn l-irregolaritajiet li ġew preskritti għandhom iħossu ruħhom responsabbli u jagħmlu tajjeb volontarjament għal ħlas ta’ fees li dawn is-sidien attwali jridu jħallsu attwali biex jiġu ‘in regola’.

Fl-aħħar nett, l-MDA tappella wkoll lill-awtoritajiet biex mil-lum ’il quddiem jiżdiedu l-pieni għal kull min qiegħed jabbuża u jikser il-liġi.
