MDA insists its Budget proposals as agreed before general election

The Malta Developers Association presented a substantial document with concrete proposals for Budget 2018, some of which can be implemented immediately.

MDA President Sandro Chetcuti, who headed a delegation of Council members, augured that the Prime Minister and his Government would continue to achieve further progress and success in its endeavours to take the country to the next level. He praised Government’s initiatives that have truly brought the best of times in terms of employment and a booming economy.

Both PN leadership contenders request meeting with MDA

The two Nationalist Party leadership contenders, Dr Adrian Delia and Dr Chris Said, held separate meetings with the Malta Developers Association Council. The meetings, held at the request of the two candidates, turned out to be two long, fruitful discussions.

Both Dr Delia and Dr Said acknowledged the good work of the MDA and its highly valid contribution to the country.

MDA calls for changes in Health and Safety law

The Malta Developers Association wishes to register its disappointment at the way company directors are being charged in Court in connection with health and safety incidents at the workplace.

While the MDA believes that the law on health and safety is a good one and it has co-operated on several occasions with the Occupational Health and Safety Authority (OHSA) to ensure that its members observe the law scrupulously, the MDA feels that there is a lacuna in this law when the owner of a project is a company.

In this regard, for example, if the owner of a development is found guilty of any infringement, when the owner is a company, the fine for this infringement is multiplied by the number of company directors who are all considered to have committed the infringement individually.

In a case currently before the Courts, even a non-executive company director has been accused of causing a worker’s death, irrespective of whether he personally had any connection with the incident that led to this death. The MDA does not agree with these types of accusations in our Courts of people who are obviously innocent.

The MDA therefore appeals to the Government to amend the law so that where it is obvious that a company director had nothing to do with any infringement of the law on health and safety at work, that person should not be held criminally responsible for this.

Il-Malta Developers Association (MDA) trid tirreġistra d-diżappunt tagħha dwar il-mod kif diretturi ta’ kumpaniji qegħdin jittellgħu l-Qorti minħabba inċidenti ta’ saħħa u sigurtà fuq il-lantijiet tax-xogħol.

Filwaqt li l-MDA temmen li l-liġi dwar is-saħħa u s-sigurtà hija waħda tajba u kemm il-darba ikkoperat mal-OHSA (Occupational Health and Safety Authority – l-Awtorità tas-Saħħa u s-Sigurtà) biex il-membri tagħha josservaw il-liġi bl-aktar mod skrupluż, l-MDA tħoss ukoll li hemm lacuna f’din il-liġi meta s-sid ta’ proġett ikun kumpannija.

Hekk, per eżempju, jekk sid ta’ żvilupp li jkun ħati ta’ nuqqas jeħel multa, meta s-sid tkun kumpanija, il-multa għall-istess nuqqas tkun immultiplikata bin-numru ta’ diretturi tal-kumpanija li kollha jitqiesu li naqsu individwalment.

F’każ li qiegħed il-Qorti bħalissa, saħansitra direttur mhux eźekuttiv ta’ kumpanija ġie akkużat li kkawża l-mewt ta’ ħaddiem, irrispettivament minn kemm personalment kellu x’jaqsam mal-inċident li wassal għal dan il-mewt. L-MDA ma taqbilx ma dawn it-tipi ta’ akkużi ta’ nies ovvjament innocenti fil-Qrati tagħna.

L-MDA għaldaqstant tappella lill-Gvern biex jemenda l-liġi sabiex fejn hu ovvju li direttur ta’ kumpanija ma kellu x’jaqsam xejn ma xi ksur tal-liġi dwar is-saħħa u s-sigurtà fuq ix-xogħol m’għandux ikun kriminalment responsabbli għal dan in-nuqqas.
